Terms and Conditions​

All products made by Cookies & Cakes by Lindz are subject to the following Terms and Conditions.

Accepting the terms and conditions and payment establishes a legally binding agreement between you and Cookies & Cakes by Lindz.

​

Cookies & Cakes by Lindz will provide a professionally decorated dessert in a timely manner as specified in your order form.

When you agree to the business terms and conditions and pay for your order, you agree that any items ordered will be reproduced as Cookies & Cakes by Lindz’s interpretation of the item and will not be an exact replica. Cookies & Cakes by Lindz  reserves the right to exercise artistic licensure to guarantee the structural, visual, and creative integrity of a cake or dessert structure. Custom cakes are a work of art; therefore, I  will not copy the work produced elsewhere due to copyright or trademark laws. The finished product(s) will be as similar as possible. I will make every attempt to provide the design as requested.

​Payment​

• Final payment is due 72 hours before delivery or pickup of the items ordered. The full amount of your order is non-refundable and non-transferable.

• Cookies & Cakes by Lindz will only relinquish an order if paid for in full 72 hours before pickup/delivery. 

​

Postponement 

If, for any reason the event is required to be postponed, please contact Cookies & Cakes by Lindz immediately. The new date proposed will be subject to availability.

Cancellations/Refunds 

If cancellation of the order is required, and it is 7 days prior to your pickup, there is a $50 fee. If cancellation is 8 or more days before your event there is no fee.

​

No Call, No Show Orders ​

Any order that is not picked up at the agreed-upon time without an attempt to reschedule is forfeited, and absolutely no refund, future credit, or date change will be permitted under any circumstances.

 

Order(s) may be donated to charity or resold at the discretion of Cookies & Cakes by Lindz .

 

Because of the nature of my business and quality and freshness assurance, I will dispose of any items that have not been picked up or delivered within 48 hours after the specified collection time has passed.

Pickup

If the customer elects to pick up the order, the customer is responsible for the order as soon as it leaves the premises of Cookies & Cakes by Lindz. Upon visual inspection of the item/s and its departure from the premises, the customer approves the order’s visual appearance and waives any rights to a refund based on the style, design or visual appearance of the cake.

 

Pickup is available for cookies and single-tier cakes. Tiered cakes will be delivered so they arrive safely and hassle-free to you and your guests.  

 

If a third party will be collecting the cake on the customer’s behalf, a release form is to be signed by that person, stating the cake is received in good condition at the time of pickup.

Care & Handling 

Cookies & Cakes by Lindz provides care and handling instructions. Customers are responsible to ensure that products get to their destination safely and stored as per the provided instructions to achieve best results for taste and quality. Cookies & Cakes by Lindz cannot be held liable for any damage to item/s due to improper care and handling after it leaves the premises of Cookies & Cakes by Lindz.​

Damage

The Customer is liable for any damage, accident, or mishap that may occur once the cake is released from the care and custody of Cookies & Cakes by Lindz. Cookies & Cakes by Lindz is not liable for any damage that may occur thereafter.

 

• The customer is responsible for providing an appropriate and secure table and environment for the cake(s). Cakes are heavy and require a sturdy table, and optimal room temperature of 75 degrees or below. Cakes and frosting are made out of butter and will melt if placed in direct sunlight or temperatures above 75 degrees,

• Cookies & Cakes by Lindz is not responsible for any damage to the cake caused by the placement of flowers or other decorations by another party.

• Cookies & Cakes by Lindz is in no way responsible for any damage that may occur due to weather conditions and/or improper setup or storage.

 

Photographs & Marketing 

I respect the privacy of all clients. I will not disclose the identity of clients (photographs of people, last names, event details, contract details) without permission. I do however, reserve the right to photograph baked goods and use those photos on my website, social media, or marketing materials. I also reserve the right to use any photographs for display or promotion without compensation to you.

Liability 

Cookies & Cakes by Lindz is not responsible for bodily injury or consequential damage which may result from services.

Agreement

By placing an order with Cookies & Cakes by Lindz, you agree to these Terms and Conditions in their entirety.
